DOT Drug Testing Rules – When and How Will I Be Tested?

Safety-sensitive employees are subject to drug tests in several situations. As a new hire, employers will want the applicant to test negative before assuming safety-sensitive roles. If a supervisor suspects that an employee is under the influence of drugs or alcohol, or possibly after an employee has been involved in an accident, tests will be conducted. Otherwise, random testing of employees is also part of the regulations.

A urine drug testing process consists of three components; the collection of the urine samples, testing in the lab and review by the Medical Review Officer. For the alcohol test, a Breath Alcohol Technician or Screening Test Technician performs the test and is mandated to protect your results.

How Can I Fail a Drug and/or Alcohol Test?

A safety-sensitive employee violates drug and alcohol testing regulations either by using alcohol on, or prior to reporting for duty, testing positive on a drug test or refusing to submit themselves for the test. If such cases, removal from the safety-sensitive duties occurs immediately.

An employer is mandated to provide a list of qualified SAPs in the local area or a referral to a service agent. Failure to provide such information could result in sanctions by the DOT modal operating administration.

The employee will then have to go through the SAP Process if they wish to return to their safety-sensitive tasks. This ensures the safety of the employee and their colleagues due to the sensitive nature of their work.

What is the SAP Process Like?

If unable to produce a negative result, the employee is required to meet a Substance Abuse Professional (SAP) for a one-on-one evaluation. The SAP will give a befitting recommendation for an education and/or treatment program. Once the employee has complied with the recommendations they will then return to the SAP for re-evaluation and assessment. The SAP will then determine whether the employee has successfully complied with the program. Lastly, the employee must take another drug test under direct observation and receive a negative drug and/or alcohol test result before they can be accepted back to safety-sensitive work.
