Failed DOT Drug Test? Now What?

If you have failed a DOT drug test, SRS can help. When you are a DOT regulated employee and work in a safety sensitive position, in the public transit, trucking, aviation, maritime, railroad or pipeline industries and have violated a DOT drug and alcohol testing regulation, you are required to go through the SAP process. A failed DOT drug test means you must see a DOT qualified Substance Abuse Professional (SAP). This means the SAP is required to have specialized training, credentialing and continuing education. The SAP must also follow specific rules and regulations regarding recommended education and/or treatment facilities. When you have a failed DOT drug test you are not eligible to perform safety-sensitive duties for any employer or as an owner operator until you are evaluated, and treated, by a SAP, per the DOT’s Part 40 regulated SAP program.

What to Expect After a Failed DOT Drug Test

When you have a failed DOT drug test your drug and alcohol testing history will follow you to your new employer. This means you can’t just quit your current job and find another one. Employers are required by law to provide certain records of your DOT and/or NRC drug and alcohol testing history to your new employer. Luckily, DOT Regulation 49 CFR Part 40 Subpart O requires your employer or a service agent of the employer to provide a list of DOT qualified SAPs (40.287).

Finding a SAP can be tough when you are looking on your own. Dealing with searching for a SAP in your area, making phone calls to find the next available appointment, and ensuring that your SAP is qualified can be discouraging. SRS makes that easy for you. As an employee, you must show compliance to the recommendations and be seen by a SAP for a follow-up evaluation. During the follow-up evaluation the SAP will determine if the employee is eligible to be considered for return to duty.
