When is a DOT SAP Evaluation Required?

When a DOT mandated safety-sensitive employee tests positive or refuses a drug and/or alcohol test, he or she must undergo a DOT SAP return-to-duty program. This program includes an initial evaluation, as well as compliance to any recommended treatment and a follow-up evaluation and must be completed before being considered to return to (or being hired to perform) safety-sensitive duties. Employees who must adhere to these regulations include railroad conductors, truck drivers, ferry operators, pipeline workers, pilots, air traffic controllers, bus drivers and more. Performing safety-sensitive duties before successfully completing a DOT SAP program is a violation of the DOT’ regulations and could result in heavy penalties for both employee and the employer.

Explaining the DOT SAP Process

First, the SAP is required to determine the nature and extent of the person’s alcohol or substance use and to assist them in obtaining treatment, if necessary. The SAP may recommend additional treatment and/or rehabilitation for the employee after the initial assessment. The level of treatment may range from weekend educational programs to inpatient treatment and rehabilitation. However, every SAP program includes the following:

· Two face-to-face evaluations

· Some type of treatment and/or education, where the level of both is determined by SAP

· SAP monitoring of employee in treatment

· Aftercare recommendations where applicable

· Two written SAP reports sent to the employer (i.e. the initial and follow-up)
