Qualified SAP List for PHMSA Mandated Employees

As a DOT mandated safety-sensitive employee, if you fail or refuse a drug and/or alcohol test, your employer has the legal right to either terminate your employment or retain you. Either way, before you can continue working in a safety-sensitive job, you must complete the return-to-duty process. This process requires working with a DOT qualified Substance Abuse Professional (SAP). Your SAP evaluates you and recommends the next steps to take. The steps may involve treatment or education programs, followed by retesting, and/or continued care, before you can return to work. Drug and Alcohol Testing Guidelines Promote Safety

The Pipeline and Hazardous Materials Safety Administration (PHMSA), follows DOT’s testing guidelines to help combat and prevent accidents caused by substance abuse. Additionally, the goal is to provide an alcohol and drug-free workplace for the safety of all employees.

Which Employees are Required to Submit Testing?

Generally, employees who perform safety-sensitive transportation duties regulated by 49 CFR Parts 192, 193, or 195 as well as commercial carriers, those in aviation, railroad, and maritime industries, and more, are subject to drug and alcohol testing. Testing occurs several times over the course of your employment with the PHMSA, or other DOT modes. All applicants for safety-sensitive positions undergo pre-employment testing. Then, once on the job, you may undergo random and reasonable cause testing, as well as testing after an accident or as part of a return-to-duty or follow-up.

How Does a PHMSA Mandated Employee Find a SAP list?

An employee who refuses or tests positive for a drug and/or alcohol test cannot return to their safety-sensitive duties until connecting with a qualified SAP to complete the return-to-duty process. In some cases, you employer will supply a SAP list. Keep in mind that you must only work with a DOT qualified SAP in order for the program to be valid. Unfortunately, not every employer updates their SAP lists and their list may contain SAPs whose qualifications are not up-to-date.
