FMCSA Requires Post-Accident Drug Testing
The Federal Motor Carrier Safety Administration (FMCSA) mandates post-accident drug testing for any safety-sensitive FMCSA mandated employee involved in one or more of the following incidents:
- Accidents with human fatalities
- Accidents with physical injuries requiring emergency medical treatment at a location remote from the scene of the accident (even if no citation is issued to the FMSCA employee)
- Damage to one or more motor vehicles that requires the vehicle be towed from the scene (even if no citation is issued to the FMSCA employee)
- Disabling damage to any motor vehicle requiring tow away
What happens to FMSCA employees who are mandated for post-accident drug testing and fail the test? First, the employee is immediately removed from their safety-sensitive duties. Next, the employee must complete a program with a Department of Transportation qualified Substance Abuse Professional (SAP) before they can return to duty.
