Due to the safety-sensitive nature of the job, DOT-mandated, safety-sensitive employees must always follow the regulations regarding drugs and alcohol. On the job, employees must:
- Not use or have any alcohol or illicit drugs while at work.
- Not report for work under the influence of alcohol or illicit drugs.
- Not use alcohol within 4 hours of work or after being called in (some modes not within 8 hours).
- Not refuse drug or alcohol testing.
- Not submit any substitution for testing.
When DOT-Mandated Employees Are Tested
DOT-mandated employees are tested for drug and/or alcohol as a part of pre-hire, any time there is reasonable suspicion of use, and after certain accidents occur. If an employee fails the drug and/or alcohol testing, they will immediately be removed from their safety-sensitive position. They must successfully complete the SAP process before they can return to work.
The SAP Process
The employee will first be evaluated by a qualified SAP. The SAP will then submit their recommendations regarding the employee’s education and/or treatment. Full compliance of all SAP requirements is expected by the employee. The SAP will then submit their recommendation to the employer, letting them know that the treatment plan has been successfully completed and the employee can submit to a return to duty drug and/or alcohol test. The employer will then decide whether the employee will be allowed to return to work.

If a DOT-mandated employee fails a drug and/or alcohol test, the employer is responsible for providing a SAP list or a service agent referral. The employee then starts calling through the list, leaving messages in the hope of finding a qualified SAP near them. As they run through the names, they will have to wait for return calls in hope of finding an available SAP in the area.
