Failing a drug test is a very serious violation for DOT-mandated employees. Due to the safety-sensitive nature of their work, failing a drug or alcohol screening means they must successfully complete the SAP process before being allowed to return to their safety-sensitive duties.
What Is the SAP Process?
If a DOT-mandated employee fails a drug or alcohol test, that person is immediately removed from their safety-sensitive position. The employer is responsible for providing the employee with a list of Substance Abuse Professionals (SAPs) or a referral to a service agent. The SAP process begins with an evaluation by a qualified DOT SAP, who will make recommendations for treatment and/or education. The employee is required to comply with these recommendations in order to be able to return to work. Once this has been completed successfully, the employee will receive another evaluation from the SAP. The SAP will then provide a written recommendation to the employer, regarding the employee’s ability to return to their safety-sensitive position. The employee will then take another drug and/or alcohol test before returning to work. It is then up to the employer whether to put the employee back to work in to a safety-sensitive position.

The search for a SAP that is qualified and nearby can be a frustrating task, especially when using a SAP list. An employee will have to start calling SAPs in their area, moving down the list and leaving phone messages. It can take a long while to make contact and set up an appointment.
