If the employee is shown to comply with the recommended program, they will be referred to submit to a return to duty drug and/or alcohol test. If they pass the test they can resume safety-sensitive duties again.
What Are the Requirements Needed for the SAP Reports?
Written reports must be submitted in writing to the DER. As the employer, you must make sure that the SAP written reports were from the SAP professional conducting the evaluation and not from a 3rd party. The report will have details on the treatment needed to address the employee’s substance abuse concern. It must include important personal information such as employee name and SSN, address, date and reason of assessment, SAP’s recommendation and phone number.
