Failed Drug Test and Trying to Find a Different Job? Think Again!
After failing a drug and/or alcohol test, many people think they can just leave their job and get hired elsewhere to avoid seeing a SAP professional. However, if you are a safety-sensitive employee you will not get hired in another DOT-mandated position without seeing a SAP professional.
Why Can’t You Switch Companies Following a Failed Drug Test?
Any FMCSA-mandated, safety-sensitive employee’s drug and/or alcohol failed test results must be submitted to the Clearinghouse, which means that an employee’s failed drug test is on record. “The Clearinghouse is a secure online database that gives employers, the Federal Motor Carrier Safety Administration (FMCSA), State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations.”
Any future company you apply with will be able to see that you failed or refused a drug or alcohol test. DOT federally regulates this to ensure that any employee who fails a drug or alcohol test completes the return to duty process with a qualified SAP professional.
Therefore, quitting your job and getting a new one with a different company is not an option. For this reason, after failing a drug and/or alcohol test, you will need to find a SAP in your area to begin the return to duty process.
What Does the Process of Seeing a SAP Professional Involve?
The first thing an employee needs to do is be evaluated by a SAP professional to determine an appropriate treatment and/or educational program. Once the SAP determines, by performing a follow-up evaluation, that the employee has successfully complied with the recommended program, the SAP will refer the employee for a return-to-duty drug and/or alcohol test. If the employee submits a negative result, they can be considered fit to perform safety-sensitive duties again.
