When a SAP Program for Truck Drivers is Necessary

Due to the nature of their jobs DOT rules mandate that safety-sensitive employees cannot be under the influence of drugs or alcohol at work. Should a DOT mandated safety-sensitive employee fail or refuse a drug and/or alcohol test, they are immediately removed from their safety-sensitive duties. Then, before they can be considered to come back to work, they’re required to complete a return-to-duty program with a DOT qualified SAP.

Employers must provide their employees with a list of SAPs. However, the DOT employer may not regularly update or check the list to ensure that the SAPs listed are up to date on their DOT qualifications. This lapse poses a problem because SAPs must keep their qualifications current, including completing 12 hours of continuing education every three years. If not, a SAP is no longer DOT qualified.

What if an employee completes their entire return-to-duty process with a SAP whose DOT-qualifications lapsed? In that case, the work isn’t recognized, and the employee must repeat the entire program. Consequently, the employee repeats the program losing more time before getting back to work.
